Appeals court hears arguments on Hegseth's bid to punish Senator Mark Kelly for video on illegal orders
The U.S. Court of Appeals for the D.C. Circuit heard oral arguments Thursday on Defense Secretary Pete Hegseth's effort to overturn a preliminary injunction blocking disciplinary action against Democratic Senator Mark Kelly, a retired Navy captain. Kelly sued after Hegseth announced plans to reduce his military rank and pay in response to a November video in which Kelly and other Democratic legislators instructed service members of their duty to resist unlawful orders. A majority of the three-judge panel appeared skeptical of the government's arguments, with judges citing military doctrine taught at Annapolis and West Point.
