Supreme Court agrees to hear case on religious preschools excluded from Colorado state funding program over LGBTQ+ admission policies
The Supreme Court agreed on Monday to hear an appeal from St. Mary Catholic Parish and the Archdiocese of Denver, who argue Colorado unconstitutionally excluded their preschools from a state-funded universal preschool program due to their faith-based restrictions on admitting LGBTQ+ families. Colorado maintains that religious schools may participate but must comply with nondiscrimination laws. The court will also consider narrowing a landmark 1990 precedent that found religious practices do not create exemptions from broadly applicable laws.
