Ninth Circuit panel declines DOJ emergency bid to set aside 20,000 California mail ballots
A 2-1 Ninth Circuit panel on Monday dismissed the Justice Department's emergency appeal seeking to require California to set aside roughly 20,000 mail ballots the government suspects belong to noncitizens. The majority found no jurisdiction because the district court was given only about 15 hours to rule, calling the emergency partly self-constructed. The underlying DOJ lawsuit against California remains pending before Judge David Carter, who scheduled a Tuesday hearing.
