Fifth Circuit rules undocumented immigrants have no constitutional right to bond hearings

The full 17-judge Fifth Circuit Court of Appeals ruled 10-7 that three detained undocumented immigrants are not entitled to bond hearings on due process grounds. The majority, written by Judge Cory Wilson, held that because the petitioners were still seeking admission, Congress controls detention rules. The ruling curtails a legal avenue used by district judges in Texas, Louisiana and Mississippi to release detainees, and comes as the Supreme Court prepares to hear a related statutory case.

The right frames the ruling as a big win for Trump's immigration agenda and no get-out-of-jail card; the left stresses it shores up ICE mass detention against nine of 11 circuits that rejected the policy.
