Trump administration proposes rule stripping tax-exempt status from private schools with race-based DEI policies
The Treasury Department and IRS proposed a regulation on September 3, 2026 that would remove tax-exempt status from private schools and colleges that provide race-based preferences in admissions, scholarships, or other programs. The rule, if finalized, would take effect for taxable years beginning after May 31, 2027, and could affect up to 18,000 private institutions. Treasury Secretary Scott Bessent stated that rebranding race-based preferences under different names does not change their discriminatory nature.
