New Jersey petitions Supreme Court to resolve prediction market regulation dispute
New Jersey Attorney General Jennifer Davenport filed a petition with the Supreme Court on September 2, 2026, asking the justices to determine whether prediction market company Kalshi can offer sports contracts under federal regulation or must comply with state gambling laws. The petition follows a circuit split between the 3rd Circuit, which ruled in April that federal law preempts state gambling regulations, and the 9th Circuit, which ruled on August 28, 2026 that states can regulate prediction markets as sports betting. Forty-four states, tribes, casinos, and other groups have opposed Kalshi's position, while the Trump administration and CFTC have backed prediction markets.
