Federal judge strikes down New York's $75 billion climate superfund law
Chief Judge Brenda Sannes of the U.S. District Court for the Northern District of New York ruled that New York's 2024 Climate Change Superfund Act is preempted by the federal Clean Air Act and cannot be enforced. The law would have required fossil fuel companies to pay $75 billion over 25 years for climate adaptation infrastructure. The ruling sided with 22 Republican state attorneys general and industry groups, and the Trump administration's DOJ supported the challenge.
