Federal judge rules Trump administration's speech-based deportations of noncitizen students violate the Constitution
On August 28, 2026, U.S. District Judge Noel Wise in San Jose, California ruled that laws the Trump administration used to revoke visas and deport noncitizen students for pro-Palestinian advocacy violate the First and Fifth Amendments. The ruling came in a lawsuit filed by Stanford University's student newspaper, the Stanford Daily, in August 2025. The judge found that the Immigration and Nationality Act provisions gave the Secretary of State unconstitutional, unlimited discretion to suppress speech.
