Federal judge strikes down Texas drag show ban for the second time
U.S. District Judge David Hittner ruled on August 26, 2026, that Texas Senate Bill 12, which restricts sexually oriented performances in the presence of minors, is unconstitutionally vague and overbroad, violating the First Amendment. This is the second time Judge Hittner struck down the law; the 5th Circuit had vacated his initial 2023 injunction and remanded the case in November 2025, allowing the law to take effect. Texas Attorney General Ken Paxton stated he would appeal the ruling immediately.
