Third Circuit Court of Appeals rejects Rep. LaMonica McIver's motion to dismiss federal charges stemming from Delaney Hall ICE facility altercation
A three-judge panel of the U.S. Court of Appeals for the 3rd Circuit ruled 2-1 that Rep. LaMonica McIver (D-NJ) cannot use the Constitution's speech or debate clause to block two of three federal charges she faces for allegedly assaulting ICE officers during a May 2025 oversight visit to the Delaney Hall detention center in Newark, New Jersey. The court sent the third charge back to the lower court for reconsideration and denied her selective prosecution claim, which must be raised after trial. McIver stated she disagrees with the ruling and is exploring further legal options.
